Nintendo\u2019s lawyers claim that the video game company has been \u201csubstantially harmed by the unlawful of execution and imposition\u201d of \u201cunauthorized Executive Orders,\u201d and the fees Nintendo has already paid to import products into the country. In response, the company is seeking a \u201cprompt refund, with interest\u201d of the tariffs it has paid.<\/p>\n<p>\u201cWe can confirm we filed a request,\u201d Nintendo of America said in a statement. \u201cWe have nothing else to share on this topic.\u201d<\/p>\n<p>While taxes and other trade policies are supposed to be set by Congress, President Donald Trump implemented <a target=\"_blank\" class=\"link\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/regulating-imports-with-a-reciprocal-tariff-to-rectify-trade-practices-that-contribute-to-large-and-persistent-annual-united-states-goods-trade-deficits\/\" data-i13n=\"cpos:5;pos:1\">a collection of global tariffs<\/a> over the course of his first year in office using executive orders and the <a target=\"_blank\" class=\"link\" href=\"https:\/\/www.congress.gov\/crs-product\/R45618\" data-i13n=\"cpos:6;pos:1\">International Emergency Economic Powers Act<\/a> (IEEPA), a law that gives the president expanded control over trade during a global emergency. The Trump administration has positioned tariffs as a way to punish enemies and bargain with trade partners, but many companies have passed <a target=\"_blank\" class=\"link\" href=\"https:\/\/www.engadget.com\/cameras\/nikon-joins-other-camera-manufacturers-in-raising-prices-due-to-tariffs-120011854.html\" data-i13n=\"cpos:7;pos:1\">the increased price of importing goods<\/a> onto customers.<\/p>\n<p>In upholding opinions from the US District Court of the District of Columbia and the US Court of International Trade, the Supreme Court removed the Trump administration\u2019s ability to collect tariffs using IEEPA, but didn\u2019t clarify how the tariffs the government had illegally collected should be returned to companies. Like Nintendo, other companies <a target=\"_blank\" class=\"link\" href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/global-companies-that-have-sued-the-us-government-tariff-refunds-2026-02-19\/\" data-i13n=\"cpos:8;pos:1\">have decided filing a lawsuit<\/a> is the best way to get refunded.<\/p>\n<p><a target=\"_blank\" class=\"link\" href=\"https:\/\/www.theguardian.com\/us-news\/2026\/mar\/06\/us-judge-lawyers-175bn-trump-tariffs-refunds\" data-i13n=\"cpos:9;pos:1\"><em>The Guardian<\/em> reports<\/a> that US Customs and Border Protection is already preparing a system to process refunds for affected companies, but that might not mark the end of Trump\u2019s tariff regime. In a press conference held after the Supreme Court released its decision, the President <a target=\"_blank\" class=\"no-affiliate-link link\" href=\"https:\/\/www.nytimes.com\/2026\/02\/20\/us\/politics\/trump-other-options-tariffs.html?smid=url-share\" data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:10;pos:1\">announced plans to introduce tariffs<\/a> using other, more constrained methods. Tariffs aren\u2019t the only obstacle Nintendo faces, either.
